RENTAL TERMS & CONDITIONS\u00a0<\/strong><\/h2>\n

Schedules and place of delivery\/return<\/h3>\n

The hours of delivery and return of the boat as well as the place will be defined by the lessor in advance of the rental according to the needs and operational capabilities in the port.<\/strong><\/p>\n

The lessee must be present at the point of delivery at least 30 minutes prior to delivery in order to receive information regarding the use of the boat, safety, review and signing of documentation before departure.<\/p>\n

In case of delay of the hirer in the delivery, immediate departure is not guaranteed,<\/strong> it is likely that there are other rentals scheduled and therefore the departure will be delayed until the completion of the deliveries scheduled in your schedule. In such a case, the Hirer may not demand financial compensation or extension of the return schedule.<\/p>\n

The delay of the hirer in returning the boat will result in the loss of the deposit.<\/strong><\/p>\n

Sailing route<\/h3>\n

The sailing route, its area and distance from\/to the base port will be determined by the lessor on the day of the rental<\/strong> depending on weather conditions and current regulations.<\/p>\n

Failure by the lessee to comply with the route, sailing area and distances indicated by the lessor will result in the loss of the deposit in addition to a safety risk.<\/strong><\/p>\n

Prices<\/h3>\n

Prices include VAT, insurance of the boat and travelers insurance.<\/p>\n

Unless otherwise agreed the prices do not include fuel<\/strong>, the boat will be delivered with a full tank and the lessee must return it in the same way, otherwise the lessor will deduct from the deposit the amount of fuel consumed plus the refueling service.
\nAmount applicable to refueling: In force on the day of rental at the service station of the port of Ciutadella.
\nAmount of the refueling service: 30 EUR (VAT inc.)<\/p>\n

Deposit<\/h3>\n

There is a deposit of 400 Eur<\/strong>. payable in cash or by credit card at the time of delivery of the boat. The deposit will be refunded after the return of the boat and the due verification of its condition and equipment.
\nThe lessee is responsible for any damage not covered by the insurance policy and for any claim from third parties for improper use of the boat.<\/p>\n

Equipment \/ Boat License<\/h3>\n

The lessee must prove to be in possession of the necessary qualifications for the skipper of the boat that requires it or present a skipper with such qualifications instead, in any case, the lessor will be ultimately responsible for the use of the boat and its companions.<\/p>\n

In the case of not presenting the minimum required qualifications at the time of delivery, the rental contract will be terminated resulting in the loss of 100% of the amount paid.<\/strong><\/p>\n

It is forbidden to exceed the maximum number of seats allowed and \/ or total weight allowed for the rented boat.<\/p>\n

Regulations<\/h3>\n

It is mandatory to comply with the navigation rules established by the Marine Command and to respect the speed limits set at 3 knots in ports, beaches and coves.<\/p>\n

It is forbidden to sail less than 100 meters from the coast and to go further than 500 meters from the coast.<\/p>\n

The demarcated area for bathers must be respected and a safe distance must be kept from boats flying a diver’s flag.<\/p>\n

It is not allowed to drag people or objects, fishing and anchoring in rocky areas or on posidonia.<\/p>\n

Menorca is a biosphere reserve, it is forbidden to dump any waste into the sea.
\nThe boat is delivered equipped with the safety elements established by the current regulations.<\/p>\n

Personal effects<\/h3>\n

The lessor assumes no responsibility for damage or loss to any property left, stored or forgotten, stored or transported on the boat by the lessee or any other person, during or after the end of the rental.<\/p>\n

The lessee assumes the risk of such losses and releases the lessor from all claims and agrees to hold the lessor free and harmless from any claims arising therefrom, for delay or delay as a result of breakdown of the vessel, and even the possible change of the sea state produced by unforeseen weather conditions once the vessel has put to sea.<\/p>\n

In the event that the vessel is unable to return to port by its own means and requires assistance due to mechanical breakdown, the client may only claim, on a case by case basis, up to a maximum of 50% of the amount paid. If the above case is due to weather conditions or any other reason beyond the company’s control, the company shall not be liable for any refund of the amount paid.<\/p>\n

Cancellations<\/h3>\n

The lessor may cancel the rental due to force majeure, operational incapacity of the port, unavailability of the boat for maintenance or breakdown and for safety reasons in navigation. In such cases the lessee will be offered another day for the rental and if this option is not possible, 100% of the reservation amount will be refunded.<\/p>\n

Lessor and \/ or lessee may request cancellation in cases of rough seas, only those in which the weather forecast of the day forecasts rain all day, wind force 4 or higher on the Beaufort scale and \/ or waves of more than 1 meter<\/strong> will be considered cancellations due to rough seas. Cloudy skies will not be a reason for cancellation. Also in such cases the renter will be offered another day for the rental and if such an option is not possible, 100% of the reservation amount will be refunded.<\/p>\n

If accidental breakdowns occur during navigation the lessee may claim a refund of 50% of the amount paid. In the event that the breakdown has occurred due to the responsibility of the lessee, such as misuse of engine and hull of the boat, the lessee shall bear the cost of repair even if they are higher than the deposit.<\/strong><\/p>\n

In case of cancellation due to personal causes of the lessee, the lessor will return:
\n75% of the amount of the reservation if the cancellation is made 30 days before sailing.
\n50% of the amount of the reservation if the cancellation is made between 30 and 15 days before departure.
\n25% of the amount of the reservation if the cancellation is made less than 15 days prior to departure.
\nNo refund will be given if the cancellation is made the day before or the same day of departure.<\/p>\n

Use of the boat<\/h3>\n

The boat is equipped with GPS system with real-time location and records of stop, distance traveled, speed and other incidents of use of the boat.<\/p>\n

The improper use or failure to comply with the instructions of the lessor will result in the loss of the deposit, in case of breakdown or damage to the boat and its engine all repair costs will be borne by the lessee.<\/p>\n

The rental is exclusively for recreational purposes and any commercial activity is forbidden. The consumption of drugs or prohibited substances is forbidden.
\nIt is forbidden to drive the boat under the influence of alcohol.<\/p>\n

Failure to comply with any of the clauses of this contract will result in the loss of the deposit, if this is not sufficient, the lessor may claim from the lessee the damages caused and discovered.<\/strong><\/p>\n

Data processing LOPD<\/h3>\n

In compliance with the provisions of the Organic Law on Personal Data Protection (LOPD), we inform you expressly, precisely and unequivocally that the data provided by you, as well as those generated during your relationship with our company, will be processed in the files under the responsibility of Tom\u00e1s Ram\u00f3n Jaimez Felguera for the purpose of maintaining and fulfilling the relationship with our company and providing services derived from the same, including the sending of communications within the framework of the aforementioned relationship.
